The fact that he worked in different capacity before the divorce is interesting. It sounds as though he chose the other career to lower the potential costs of support and alimony. Mothers fathers do this the are in the middle. Why didn't the court/attorney go through a financial summary of his earnings? That would account for the financial earnings difference. I understand about the costs of fighting the financial claim. It's still going to be a legal cost to you. Consider all the areas involved before you return to court. If he's lost income (legitimately) and can show records of tax returns for the $30k, he can state he's had an economic change. He cannot legally determine to pay less to you unless he goes to court. If he lowers any payments without a court order, it is illegal as you have a binding agreement (the divorce) which states the actual amount. How old are the? How is you relationship with him otherwise? How do the feel about their dad? Is the financial situation a struggle, or just less than you'd like for them? Lastly, are term finances concerned (college, medical expenses). Remember, the person with the lower income can claim the for financial aid. That's a consideration if they're heading to college. If you are really doing this "for the -", please consider all the above again. Returning to court is exactly the same emotional pain as filing a divorce in the first place. After 3 years, some of the healing has happened. Do you want the fresh emotional wound? This goes for the as well. The judge won't just "believe" anyone. Proof has to be shown always (tax returns, credit card slips, any loans received and paid, -'s) it's lengthy and the paperwork involved on both sides can be enormous. The labor bureau be irrelevant depending on how properties are involved and active. How much he's working (f/t, p/t) and any other jobs he does for his sis. I'm not promoting a modification, I'm only telling you what I know about it and your options. My modification was arduous to work on and I did most of the work myself. It holds him accountable though I don't know if I would do it again, knowing what I know now. Good luck.
